Probo Media Technologies Pvt. Ltd. (the “Company”) is committed to protecting the privacy of its users. This Privacy Policy (“Privacy Policy”) is designed to help you understand what information we gather, how we use it, what we do to protect it, and to assist you in making informed decisions when using our Services (as defined in the Terms andConditions).

This Privacy Policy is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and the rules made thereunder including but not limited to Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and the amended provisions pertaining to electronic documents / records in various statutes as amended by the Information Technology Act, 2000. This Privacy Policy does not require any physical, electronic or digital signature and is a legally binding document between You and Probo.

You also have an option to withdraw your consent given earlier to us. Such withdrawal of consent should be sent us in writing at communication@probo.in.

We may collect both “Non-Personal Information” and “Personal Information” about you. “Non-Personal Information” includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. “Personal Information” includes information that can be used to personally identify you, such as your name, address, age, contact number, bank account number (banking data such as UPI and IMPS), email address , Government ID like Aadhar Card or driving licence or Voting ID and Pan Card.

We may track information provided to us by your browser or use of the website, such as the referring website from which you came to our website, the type of browser you use, the device from which you connected to the website, your IP Address, the time and date of access, and other information that does not personally identify you. We use this information for various purposes, inter alia, the operation of the website, to improve our services, to improve your experience on our website, to understand varied requirements for different users etc.

b. Website Forms

There may be online forms present on our website where you are able to submit personally identifiable information in order to express interest in the Services or submit an inquiry regarding the Services. These forms may appear in different formats that request your information before submitting. When you contact us using a form on our website, we collect information that identifies you, such as your name, age, phone number, email address, postal address and other personally identifiable information. This information is used to understand your requirements and suggest the right Services for you. We do not use this information for marketing purposes or share this information with any third-parties.

c. Telephonic and Email Communications

Based upon the Personal Information that you provide us, we may contact you via a telephone call to understand your requirements in detail and provide further information about our Services. By providing your mobile phone number, landline telephone number you are expressly consenting to us contacting you in spite of any registrations you may have with your telecom providers “Do Not Disturb” registry. We may also communicate with you via email correspondence.

We may also use your Personal Information to send you updates and other promotional communications. If you no longer wish to receive email correspondence or updates from us, you may opt-out of receiving them you may contact us and let us know.

d. Social Media

We may collect information when you interact with our social media accounts and pages such as on LinkedIn, Twitter, Telegram, Instagram, Facebook etc.

III. Data Usage

We will use the data provided by you to us to provide the Services, provide you with information about the Services, troubleshoot our website and diagnose problems and in relation to legitimate business needs functions such as those related to payments or changes in service reducing and addressing instances of fraud and protecting both you and the Company.

We do not sell, trade, rent or otherwise share your Personal Information with third parties without your consent. We may share your Personal Information with vendors and other third-party providers who are performing services for the Company. In general, the vendors and third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide for the Company. These services by such vendors shall include but not be restricted to payment information required by a payment aggregator/gateway to process a payment made for the Services, logistics partners to deliver kits/parts required for completion of the Services etc.

Payment aggregators/gateways typically have their own privacy policies in respect of the information that we are required to provide to them in order to use their services and we recommend that you read their privacy policies so that you can understand the way your Personal Information will be handled by such providers.

We may be required to disclose your Personal Information by law on receipt of a lawful notice from a competent statutory/investigatory authority. Such disclosures will be made in compliance with the applicable law and we will be under no obligation to inform you of such disclosure to the competent authority. We may also be required to disclose your Personal Information to a competent authority if it is found that you have violated our Terms & Conditions and/or have committed an illegal act while using our website and/or Services.

We will use your Non-Personal Information to help us improve the Services. We will also aggregate and anonymize Non-Personal Information in order to track usage of our website and Services. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our sole discretion.

The security of Your Personal Information is important to Us. We follow generally accepted industry standards to protect the Personal Information submitted to Us, both during transmission and once We receive it. All information gathered on Our Website is securely stored within Our controlled database with adequate cryptographic controls. The database is stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. Although We make best possible efforts to store Personal Information in a secure operating environment that is not open to the public, You should understand that there is no such thing as complete security, and We do not guarantee that there will be no unintended disclosures of Your Personal Information. VI. Age of Consent

By using the website, you represent that you are at least 18 years of age to access the website and Services. We do not provide any of our services to any person under the age of 18 years.

VII. Disclaimer

Several deceptive emails, websites, blogs etc. claiming to be from or associated with Us may be circulated or are circulating on the Internet (“Deceptive Communication”). Such Deceptive Communication may include our logo, photos, links, content or other information. Some Deceptive Communication may call the User requesting the User to provide Mobile Number, OTP etc. or any other information and inform the User that the User has won a prize/ gift or provide a method to commit an illegal/ unauthorized act or deed or request detailed Personal Information or a payment of any sort. The sources and contents of these Deceptive Communications and accompanying materials are in no way associated with Us. For your own protection, we strongly recommend to not respond to such Deceptive Communication. You agree that we shall not be liable for any direct or indirect, consequential or inconsequential loss, damage and/or harm that you may suffer by relying and/or acting upon such Deceptive Communications.

Except, as provided for the purpose of verification, as set out under the Terms and Conditions, We and/or Our employees will not contact you to divulge your SPDI (Sensitive Personal Data and Information).

VIII. User Account and Data Deletion

Users are entitled to request Us to delete their User accounts and their personal information by sending an email with their written request support@probo.in.

We will do our best to respond promptly and in any event within one month of the following:

  • Our receipt of your written request; or
  • Our receipt of any further information we may ask you to provide, to enable Us to comply with your request, whichever is later.

As an alternative to account deletion, by writing to support@probo.in, you also have the option to request either:

  1. the suspension of your account, after which you will not be able to play contests on your User account but will continue to have access to other parts of the Portal; or
  2. temporary deactivation of your account, where you will no longer be able to log into the Portal but which allows you to request reactivation of your account with all your account data.

If you proceed with permanent deactivation of your account, you will lose access to the Portal and the Services, including any User data and personal information associated with your account. Users may request for account restoration within six (6) months from the date of notification of account deletion by writing to support@probo.in

When you request deletion of your data, We follow a deletion process that ensures that your data is safely and completely removed from our servers or retained only in anonymised form. We try to ensure that our services protect information from accidental or malicious deletion.

IX. Data Retention

Your Personal Information may be retained and continued to be used only for the purpose for which the information has been collected. We shall no longer retain your Personal Information if: (i) the relevant purposes for the use of your Personal Information is no longer applicable; and (ii) we are no longer required by applicable law, regulations, contractual obligations to retain such information.

We reserve the right to change this Privacy Policy and our Terms & Conditions at any time. You will be informed of any changes to our Privacy Policy when such changes are effected.
